1. Acceptance
By accessing or using the Service, you confirm that you have read, understood, and agreed to these Terms. If you use the Service on behalf of an organization, such as a venue, you confirm that you are authorized to bind that organization.
2. Eligibility
You must be at least 13 years old to create an account. If you are between 13 and the age of majority in your province, you confirm that a parent or guardian has reviewed these Terms and the privacy policy with you.
3. Accounts
- You are responsible for safeguarding your credentials and for activity that happens through your account.
- Keep your email address current. We use it for sign-in confirmations, submission updates, receipts, and service notices.
- Tell us promptly at hello@connectyxe.ca if you think your account has been accessed without authorization.
- You may delete your account at any time by emailing us. The privacy policy explains what happens to your data.
4. Submissions and content licence
When you submit events, images, claims, comments, or other content (“submissions”), you represent that:
- The information is accurate to the best of your knowledge.
- You own the submission or have the rights needed to share it with us.
- The submission does not infringe any third party's intellectual-property, privacy, or publicity rights.
You keep ownership of your submissions. By submitting content, you grant ConnectYXE a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, adapt, edit, translate, format, summarize, publish, and display it to operate and promote the Service, including in our newsletter and on our social channels. This licence survives termination of your account only as far as needed to keep already-published listings intact.
The Service is editorially curated. We may approve, reject, edit, re-categorize, re-image, or remove any submission at our discretion.
5. Acceptable use
You agree not to use the Service to:
- Post content that is unlawful, hateful, harassing, defamatory, threatening, sexually explicit involving minors, or that promotes violence or discrimination prohibited under Saskatchewan or Canadian law.
- Impersonate a venue, organization, or person, or misrepresent your affiliation with any of them.
- Submit duplicate, automated, or spam listings, or inflate RSVPs, saves, or other engagement metrics.
- Access accounts, data, or systems you are not authorized to access. Report any vulnerability privately to hello@connectyxe.ca rather than exploiting it.
- Scrape, copy, or republish a substantial part of the Service without our written permission, or use the Service or its content to train commercial machine-learning models.
- Interfere with the Service or place unreasonable load on its infrastructure.
- Break any applicable law.
6. Paid placements and payments
Some surfaces are paid placements, and they are always clearly labelled. Paid placements run alongside editorial content, not in place of it, and remain subject to section 5 (acceptable use).
Payments are handled by a third-party payment processor under its own terms. By buying a placement you authorize the charge in Canadian dollars (CAD) for the amount shown at checkout, including any applicable taxes.
- Before the placement runs
- You may cancel for a full refund of the placement fee.
- While the placement is running
- If we pull a placement for failing our editorial standards (other than a breach of section 5 by you), we refund the unused portion on a pro-rata basis. If you cancel for any other reason, the fee for the elapsed period is non-refundable and we may refund the unused portion at our discretion.
- Service unavailability
- If a sustained outage materially prevents your placement from running as purchased, we will extend it by the length of the outage or, if you prefer, refund the unused portion.
- Chargebacks
- If you charge back a placement that ran as purchased, we may suspend your account and decline future placements until the dispute is resolved.
- Taxes
- Displayed prices are in Canadian dollars and include any applicable Canadian sales taxes. If we are later required to collect tax separately, we will show it as a line item before you confirm.
Refund requests: email hello@connectyxe.ca from the account that bought the placement. We respond within 10 business days.
7. Copyright notices
We follow the Notice-and-Notice regime under sections 41.25 and 41.26 of the Copyright Act (Canada). If you believe content on the Service infringes your copyright, send a notice to hello@connectyxe.ca that includes:
- Your name, address, telephone number, and email address.
- Identification of the copyrighted work you say is infringed.
- The URL or other location of the allegedly infringing material.
- The date and time you first observed the alleged infringement.
- A statement of the claimed infringement.
On receiving a compliant notice, we will forward it to the user associated with the material, as required by law, and may remove or disable access to the material pending resolution.
8. Our intellectual property
Editorial copy written or edited by ConnectYXE, along with the ConnectYXE name, logo, brand assets, layout, design, and software, are owned by us or our licensors and protected by copyright, trademark, and other law. You may link to and share pages from the Service for personal, non-commercial use. Any other use needs our written permission.
9. Third-party events and links
The Service lists events run by independent venues and organizations. Plans change: events get cancelled, prices change, venues move. Always confirm with the venue or organizer before you commit time or money. ConnectYXE is not the operator, host, ticket seller, or guarantor of any listed event, and your participation is at your own risk.
Listings come from a few sources: information our automated tools collect from publicly available venue, organizer, and aggregator websites; events submitted by venues and members; and our own editorial research. Automatically collected listings cover descriptive facts (title, date, time, venue, price, a short summary) and link back to the original source. If you run a venue or event and want a listing corrected or removed, email hello@connectyxe.ca.
The Service may link to third-party sites (venues, social channels, ticket providers, payment processors). We do not control those sites and are not responsible for their content, accuracy, security, privacy practices, or terms.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, security, or uninterrupted operation.
Some consumer rights under Canadian or Saskatchewan law cannot be excluded; nothing in this section limits those rights.
11. Limitation of liability
To the maximum extent permitted by law, ConnectYXE and its operators, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of, or inability to use, the Service, even if we were advised of the possibility.
Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) CAD $100.
These limits do not apply to liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by our negligence.
12. Indemnification
You agree to defend, indemnify, and hold ConnectYXE and its operators harmless from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of (a) your submissions, (b) your breach of these Terms, or (c) your violation of any law or any right of a third party. This does not apply to claims caused by ConnectYXE's own gross negligence or wilful misconduct.
13. Suspension and termination
We may suspend or end your access at any time if we reasonably believe you have breached these Terms, your use poses a security or legal risk, or the law requires it. Where practical, we will give notice and a chance to fix the issue. You may stop using the Service and delete your account at any time by emailing hello@connectyxe.ca.
14. Changes
If we make a material change to these Terms, we will notify you by email or a prominent notice on the Service at least 14 days before it takes effect. Continued use after the effective date means you accept the updated Terms. Minor edits are reflected in the effective date above.
15. Governing law and disputes
These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada that apply in Saskatchewan, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before going to court, the parties will try to resolve a dispute informally. Send written notice describing the dispute and the relief you want to hello@connectyxe.ca; we will respond within 30 days. If the dispute is not resolved within 60 days, either party may go to court.
You and ConnectYXE submit to the exclusive jurisdiction of the courts in Saskatoon, Saskatchewan, except where consumer-protection law lets you bring the claim in your home province. Nothing here prevents either party from seeking urgent injunctive relief.
16. General
- Severability. If a provision is unenforceable, the rest stay in full force.
- No waiver. Not enforcing a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our written consent. We may assign them in a merger, acquisition, or asset sale.
- Survival. Sections 4 (content licence, to the limited extent stated), 8, 10, 11, 12, and 15 survive termination.
- Entire agreement. These Terms and our privacy policy are the entire agreement between you and ConnectYXE about the Service.
