1. acceptance
by accessing or using the service you confirm that you have read, understood, and agreed to be bound by these terms. if you are using the service on behalf of an organization (for example, a venue), you represent that you are authorized to bind that organization.
2. eligibility
you must be at least 13 years of age to create an account. if you are between 13 and the age of majority in your province of residence, you confirm that a parent or guardian has reviewed these terms and the privacy policy with you.
3. accounts
- you are responsible for safeguarding your account credentials and for any activity that occurs through your account.
- keep the email address on file current. we use it for sign-in confirmations, submission updates, receipts, and service notices.
- notify us promptly at hello@connectyxe.ca if you believe your account has been accessed without authorization.
- you may delete your account at any time by emailing us. see the privacy policy for details on what happens to your data.
4. submissions + content licence
when you submit events, images, claims, comments, or other content (collectively, “submissions”), you represent and warrant that:
- the information is accurate to the best of your knowledge;
- you either own the submission or have the rights necessary from the rights-holder to share it with us;
- the submission does not infringe any third party's intellectual-property, privacy, or publicity rights.
you retain ownership of your submissions. by submitting content, you grant ConnectYXE a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, adapt, edit, translate, format, summarize, publish, display, and otherwise use your submission to operate and promote the service, including in our newsletter and on our social channels. this licence survives termination of your account only to the extent necessary to preserve the integrity of approved listings already published.
the service is editorially curated. we may approve, reject, edit, re-categorize, re-image, or remove any submission at our discretion.
5. acceptable use
you agree not to use the service to:
- post content that is unlawful, hateful, harassing, defamatory, threatening, sexually explicit involving minors, or that promotes violence or discrimination prohibited under Saskatchewan or Canadian law;
- impersonate a venue, organization, or another person, or misrepresent your affiliation with any of them;
- submit duplicate, automated, or spam listings, or manually inflate RSVPs, saves, or other engagement metrics;
- attempt to access accounts, data, or systems you are not authorized to access; probe the service for vulnerabilities only through coordinated disclosure to hello@connectyxe.ca;
- scrape, copy, or republish a substantial portion of the service without our written permission, or use the service or its content to train commercial machine-learning models;
- interfere with or disrupt the operation of the service or place unreasonable load on its infrastructure;
- use the service to violate any applicable law.
6. paid placements + payments
some surfaces are paid placements and are always clearly labelled. paid placements run alongside (not in place of) editorial content and remain subject to section 5 (acceptable use).
payments are processed by a third-party payment processor under that processor's own terms. by purchasing a placement you authorize the charge in Canadian dollars (CAD) in the amount displayed at checkout, inclusive of any applicable taxes.
- before the placement runs
- you may cancel for a full refund of the placement fee.
- while the placement is running
- if we pull a placement for failing our editorial standards (other than a violation by you of section 5), we will refund the unused portion on a pro-rata basis. if you cancel for reasons other than our breach, the fee is non-refundable for the elapsed period; we will refund the unused portion at our discretion.
- service unavailability
- if a sustained outage materially prevents your placement from running as purchased, we will extend the placement by the duration of the outage or, at your election, refund the unused portion.
- chargebacks
- if you initiate a chargeback for a placement that ran as purchased, we may suspend your account and decline future placements until the dispute is resolved.
- taxes
- prices displayed are in Canadian dollars and include any applicable Canadian sales taxes. if we later become required to collect tax separately at checkout, we will show it as a separate line item before you confirm.
refund requests: email hello@connectyxe.ca from the account that purchased the placement. we will respond within 10 business days.
7. copyright notices
we comply with the Notice-and-Notice regime under sections 41.25 and 41.26 of the Copyright Act (Canada). if you believe content on the service infringes your copyright, send a notice to hello@connectyxe.ca that includes:
- your name, address, telephone number, and email address;
- identification of the copyrighted work claimed to be infringed;
- the URL or other identifier of the allegedly infringing material;
- the date and time the alleged infringement was first observed; and
- a statement of the claimed infringement.
on receipt of a compliant notice, we will forward it to the user whose account is associated with the material, as required by law, and may remove or disable access to the material pending resolution.
8. our intellectual property
editorial copy written or edited by ConnectYXE, the ConnectYXE name, logo, brand assets, layout, design, and software are owned by us or our licensors and are protected by copyright, trademark, and other intellectual-property law. you may link to and share pages from the service for personal, non-commercial use. any other use requires our written permission.
9. third-party events + links
the service lists events run by independent venues and organizations. plans change: events get cancelled, prices change, venues move. always confirm with the venue or organizer before you commit time or money. ConnectYXE is not the operator, host, ticket seller, or guarantor of any event listed on the service. your participation in any event is at your own risk.
the service may include links to third-party websites (venues, social channels, ticket providers, payment processors). we do not control those sites and are not responsible for their content, accuracy, security, privacy practices, or terms of use.
10. disclaimers
to the maximum extent permitted by applicable law, the service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, security, or uninterrupted operation.
some of the rights you have as a consumer under Canadian or Saskatchewan law cannot be excluded; nothing in this section limits those rights.
11. limitation of liability
to the maximum extent permitted by applicable law, in no event will ConnectYXE, its operators, employees, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of (or inability to use) the service, even if we have been advised of the possibility of such damages.
our aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) CAD $100.
the limitations in this section do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by our negligence.
12. indemnification
you agree to defend, indemnify, and hold ConnectYXE and its operators harmless from and against any claim, demand, action, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or related to (a) your submissions; (b) your breach of these terms; or (c) your violation of any law or any right of any third party. this section does not apply to claims caused by ConnectYXE's own gross negligence or wilful misconduct.
13. suspension + termination
we may suspend or terminate your access to the service at any time if we reasonably believe you have breached these terms, your continued use poses a security or legal risk, or we are required to do so by law. where practical, we will give notice and a reasonable opportunity to remedy. you may stop using the service and delete your account at any time by emailing hello@connectyxe.ca.
14. changes
if we make a material change to these terms we will notify you by email or via a prominent notice on the service at least 14 days before the change takes effect. continued use after the effective date means you accept the updated terms. minor edits will be reflected in the effective date at the top of this page.
15. governing law + disputes
these terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable in Saskatchewan, without regard to its conflict-of-laws principles. the United Nations Convention on Contracts for the International Sale of Goods does not apply.
before pursuing a dispute in court, the parties will attempt to resolve it informally. send written notice describing the dispute and the relief sought to hello@connectyxe.ca; we will respond within 30 days. if the parties cannot resolve the dispute within 60 days, either party may proceed to court.
you and ConnectYXE submit to the exclusive jurisdiction of the courts located in Saskatoon, Saskatchewan, except where applicable consumer-protection law permits you to bring the claim in the courts of your home province. nothing in this section prevents either party from seeking urgent injunctive relief.
16. general
- severability. if any provision is held unenforceable, the remaining provisions remain in full force.
- no waiver. our failure to enforce any provision is not a waiver of our right to enforce it later.
- assignment. you may not assign these terms without our written consent. we may assign them in connection with a merger, acquisition, or sale of assets.
- survival. sections 4 (content licence, to the limited extent stated), 8 (intellectual property), 10 (disclaimers), 11 (limitation of liability), 12 (indemnification), and 15 (governing law + disputes) survive termination.
- entire agreement. these terms, together with our privacy policy, constitute the entire agreement between you and ConnectYXE regarding the service.
